I can’t even explain how incredibly ANGRY I am. This is supposed to be the best time of my life. I just bought an awesome new car, I’m in escrow for my first house, I’m in love with the person I’m going to spend the rest of my life with, my business has grown beyond my wildest expectations, for the 1st time in my life, I have a decent amount of money saved and…I’M INCREDIBLY FUCKING PISSED OFF.

While all of these amazingly awesome things are happening, I just can’t get over the pathetic loss of control of one Carlsbad police officer. Essentially, what happened that night was that my big mouth embarrassed officer (edit: I removed the officers name until I get the correct spelling) to the point where he lost control. He was so pissed off that I called him a moron and flipped him off in front of a group of people that he tasered me THREE TIMES and arrested me. Obviously, tasering a 118 pound girl with no reason is not really acceptable, so he made up some charges in order to arrest me and to try to (weakly) justify his actions. I’m being charged with the following three crimes:

- Drunk in public

- Trespassing

- Resisting arrest

Can someone please explain to me how I could be “drunk in public” and “trespassing” at the same time? Any one? And for the “resisting arrest” charge, that is just fucking pathetic. I stand 5’6″ tall, weigh 118lbs and I got hit from behind by someone that did not identify themselves as a police officer. Yes, I was slightly dazed and tried to get to my feet. I hardly think that should scare a police officer enough to think that his only resort was to taser me while I was layed out, face down on the sidewalk and he was on top of me.

I spent 2 hours in the hospital. When the officer took me to the hospital for “routine vitals” since I got tasered, my heart rate was DOUBLE what it normally is and the doctor would not release me. Since drinking fluids did not bring down my heart rate, I had to be hooked up to an IV. When that still did not bring my heart rate back to normal levels, I was given a drug test (and, yes, that came up 100% clean, of course).

There’s plenty more to this story that will make you think, “You have to be fucking kidding…”, but the more I talk about it the more pissed off I become, so I’m going to try and get some work done before I toss and turn and continue to stew about this…In the begining I was (almost) fine because I believed in the justice system and thought that the officer that did this will get what’s coming to him because HE IS GUILTY and I AM INNOCENT, but the more I think about it and the more stories that people tell me, the more worried, sad and angry I get. I tried asking some simple questions to the police chief of Carlsbad and he was totally rude an elusive. He told me that I could not get a copy of my police report and that I would have to hire a lawyer to get it (which is complete bullshit). So basically, to defend myself against these incredibly stupid, false charges, I have to hire a lawyer and private investigator, which will cost me about $20,000 out of pocket. Which I might be able to recover a year or two down the road, if I sue the Carlsbad Police Department. But, winning a case would mean that the judge and jury would have to believe me and my witnesses over a police officer and his witnesses. Even though I am an outstanding citizen and Carlsbad business owner, I am instantly at the disadvantage of a cop that will obviously lie in order to save face.

Now can you see why I’m incredibly fucking pissed off?!

    Just reading this post gets me angry again. I was threatened with arrest while I was gathering unbiased witness’s names and telephone numbers after the event went down. The charge? Loitering and Drunk in Public. This was a police tactic to get me to leave the scene. When I went to hop on my bike to ride home and wait for a phone call from Summer (since they were taking her to jail) I was told that they could issue me a DUI for riding my bike under the influence (which is true). It was recommended to me to walk my bike. I was getting strong-armed by the law…not as bad as being tasered, but helpless nonetheless.

    We live this night in one aspect or another every day. We try not to discuss it every day because it gets us both in a bad mood and often leads to heated discussions over the money it is going to cost to defend summer, whether the officer is going to get reprimanded and often to an intellectual debate over the principal issues here; Is it better to walk away from this thing and move out of this town and let the cop continue with his alleged unprofessional behavior and alleged use of excessive force (like on a 118lb girl) or should we commit the $20k to lawyers, private investigators and expert witnesses to show the world the alleged poor tact of the Carlsbad Police Department. Now I’m stressed again and it’s only 8:30am…AND I’M ON VACATION!

    There isn’t one day that goes by that I don’t double take at a Carlsbad Police cruiser (or any cop for that matter) wondering if they are going to pull me over. I don’t feel like our tax dollars (and I pay a lot of tax dollars) are protecting us anymore. More of that money needs to go towards funding constant training to our police officers to help them be better guardians of the people and to keep personal feelings out of their job. The law is cut and dry, our emotions are not. It’s a helpless feeling when you don’t feel like you can trust the police in the city of Carlsbad, the town in which you live and enjoy the mom and pop shops and restaurants…all because of the action of one police officer who is paid to protect the rights of its law abiding citizens against criminals.

    Bad things happen to good people unfortunately way too often. Dont allow some clown rogue cop to change your life. Get pissed and then let it go. Easy for me to say of course but why give them control of your feelings? The laws are structured to make it easy to intimidate anyone they want.

    Dont invest any time or money thinking your going to change one cop or police department. Wont happen but will just waste your time and make you more pissed. The truth is out in the streets its their world. Accept it and cop a plea for disturbing the peace? I wont waste your time with my tales of horror but they may not seem so wild now.

    One of my brothers recently had a similar experience, after a concert and getting caught short in public. A policeman stopped him (well not mid stream). The policeman turned away to round up other wrongdoing concert goers, and embarassed as he was in his imbibed state, my brother decided to make a getaway, and was promptly rugby (american football) tackled to the ground. The reaction to the escape was a bit OTT, my brother struggled a little ,as you would, and was arrested for ‘assaulting a police officer’, not an easy feat when you’re face down with a large officer on top of you. =P

    2 sober friends who were witnesses testified that the tackling was uncalled for. The police changed minor details of their story and my bro got a £200 fine.
    Maybe the officer had a bad day and just wanted to vent some frustration, maybe he wanted to make an example (although pipi in public is hardly crime of the century), going up against the system is difficult.
    If you do fight them on this my thoughts (and hopes) are with you.

    If an officer gives you an order, follow it.
    If an officer says you’re under arrest, don’t fight it.
    If you have been drinking and you’re not in a bar or your own home, you could be charged with being drunk in public–especially if you’re being a jerk.

    It’s simple. Follow what the officer says. BE RESPECTFUL NO MATTER WHAT.
    Then take it to a lawyer if you have a problem.

    Court is the time to settle injustices–not when you are out on the street against an officer with a gun and TASER.

    It’s simple. Officers sometimes make mistakes. But you were a bitch and called him names, flipped him off, etc… So yeah–you’re getting Drunk in Public slapped on you.

    If you want to avoid that, don’t be a bitch to the officer.

    Secondly, it doesn’t matter if you’re 118 pounds, 450 pounds, or 80 pounds. If you are out of control and not following the officers commands, they can use the TASER on you.

    Do you understand that there are consequences to your actions? You may not always know what the consequences are, or you might not think about them before-hand, but they will apply to you.

    Yep, I did leave out quite a bit of information. Like the fact that I wasn’t drunk. I asked for a blood alcohol test 3 times at the hospital and I asked for a breathalyzer twice at the police station. The officer wouldn’t let anyone test me (because he knew I wasn’t drunk and didn’t want me to have the proof).

    The short version of what happened before getting tasered: I was arguing with a bouncer that was not letting patrons use the restroom at a restaurant/bar (which is against the law). I turned to the police officer and asked him to tell the bouncer that what he was doing was against the law. The officer stared at me blankly, so I said, “You DO know the LAW don’t you”. His reaction was telling me to leave or I would be arrested for trespassing. I called them both morons, flipped them off and turned around to walk out. As I was walking outside, I was grabbed from behind by the cop and thrown to the pavement. Commence tasering…

    As much as most people that don’t know me, want to hate me (see Digg), calling an officer a moron and/or flipping them off is not a crime.

    If you had a pacemaker you could be dead. While I do know and side with many cops, troopers, etc… I think this case the officer was powertripping and needs to be put into check. Tasering should be considered a much more serious action then it is currently.

    There was just a story on the national news about this, people are filing lawsuits against the manufacturer of Tazers and researchers are disputing the false claim by police and the maker of the device that being shot with one poses no long term health risks.

    Run a search on the lawsuits and health investigations going on with this and you can get in line to file your multi-million dollar lawsuit against the police and the maker of this device.

Cops know what sort of job they are taking when they chose to become a police officer. If they can’t handle the pressure or the job, they shouldn’t be cops.     The funny thing (well, it would actually be sad if I hadn’t moved out of the US) is that these are the type of losers that will end up in your local police departments. Ones that hold their pride over your rights.

    Like I said before, I was taught that Americans had the freedom of speech. It is perfectly legal to flip someone off and/or call them a “fucking moron”. It is not legal to attack someone from behind, throw them to the ground, taser them 3 times, then lie under oath in a court of law. Unfortunately Christopher Karches of the Carlsbad Police Department broke the law and lied to cover his ass. I thought I was doing other citizens a favor by fighting for my own and their rights, but apparently the majority of people I was doing this for are total douche bags. So, enjoy your corrupt police departments and remember me when the same thing happens to you and your whining about how you should have rights. ;)

    -Sigh- I feel for you. Truly, I do. I’ve been in a similar situation myself, (though, not concerning a cop.)and in the end, nothing was justified. Really, what’s the American legal system coming to?

    Wow, this is the craziest thing I’ve read! I just saw the last comment (psycho) on the side bar and followed it to this post. What’s really weird is that Britton and I just got done watching The Changeling last night.

    Have you seen it? It’s a true story and (partly) about the corruption in the police system in Los Angeles in the late 1920s after a woman’s child went missing. The police tried to give her someone else’s kid to cover up the story. When she wouldn’t accept the strange child as her own, they threw her into the mental ward and abused her. They called her all sorts of names, said she was a bad mother, but in the end she helped to expose the corruption and cleaned out the whole police department.

    I went through something kind of similar in high school (without the physical abuse you went through, but lots of corruption). The school board, accountability committee, principal, superintendent (who were brothers), and school counselor were all ousted as a result after court and all sorts of media exposure. It was a bittersweet consolation prize though for what happened and I still think about it over 10 years later. But I try to let it be water under the bridge as much as possible.

I especially love the commenters like our anonymous “Bob” up there.     I can totally imagine what you went through in high school…High school was the very first time I witnessed an “authority figure” (the Dean of Students) blatantly lie about a student to get them thrown out of school. Weird stuff when you’re a kid that was taught that authority figures would never do such a thing. I’m glad you did something about it, most people don’t have the balls.

    i am fucking pissed off too!!!!! i was promised to go to the fair with my friends and help out at the church’s stand there, when all of a sudden a half an hour to five and my mom says that i cant go!!! she says that we dont have enough money to do anything until she gets paid, and my sis and bro have enough for me to go i asked to let me use their money and my mom said that she would use it to get milk, i discovered that we have 2 milk cartons!!! certainly enough milk to last till monday!!! so i am fucking pissed off!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
